Analysis of Problematic Issues in the Activities of Charitable Organisations in Ukraine (Taking Into Account the Experience of the United States)
Abstract
Abstract. The relevance of the study is determined by the existence of problems in the activities of charitable organisations in Ukraine. The aim of the study is to conduct a comprehensive analysis of the legal regulation of charitable activities in Ukraine and the United States with a view to using positive experience for the Ukrainian state. Problematic issues in the activities of charitable organisations in Ukraine and the United States are analysed, and shortcomings and positive practices are identified. The author argues that the field of charity has sufficient legal regulation. Despite numerous positive practices, it has shortcomings and problems. Ukraine can take into account the experience of reforming the charitable sphere in the United States and use it to improve national standards in the field of charity, in particular, to form an understanding of charity in the minds of people not only as a socially necessary activity, but also as a lifestyle, state regulation and support of charitable activities, and freedom in the activities of charitable organizations. In conclusion, it is noted that national legislation needs to be improved in order to support and develop the institution of charity and entities engaged in such activities. The need to consolidate the legal status and guarantees of volunteer activities is justified, and the need to adopt a law regulating the process of providing and receiving humanitarian aid is proven. In writing this article, general scientific and special legal methods and a comprehensive approach were used. The practical significance of the study lies in the fact that the author has identified measures to improve the legal regulation of charitable activities in Ukraine based on the problems identified in their activities, taking into account the positive experience and shortcomings
in US legislation.
