Abstract

Abstract. The article is devoted to the theoretical and applied analysis of the methodology and methods for ensuring the effectiveness and quality of laws in the context of the updated legal regulation enshrined in the Law of Ukraine «On Lawmaking» dated August 24, 2023, No. 3354-IX. The authors emphasize that the validity of a normative legal act does not guarantee its effectiveness or compliance with social needs, and therefore the need for a scientifically based methodology for implementing laws is extremely relevant. The article proves that the effectiveness and quality of legislation should be assessed through the existence of sustainable legal regulation, the achievement of expected results, the stability of law enforcement, compliance with European legal standards, and the preservation of legal balance in the state. The concept of the methodology and methods of implementing laws as an integrated system covering key stages is scientifically substantiated: informing subjects, assimilation of legal norms, organizational and practical implementation, law enforcement, control, effectiveness assessment, legal monitoring, and improvement. The work defines the principles on which the methodology and techniques should be based: the rule of law, legal certainty, consistency, predictability, democracy, compliance with public interests, scientific rigour, transparency and resource availability for implementation. The authors justify the need to develop and implement a Scientific Concept for the Development of Ukrainian Legislation as a basic strategic document that will allow adapting the national legal system and increasing its stability and adaptability to change. Particular attention is also paid to the prospect of adopting a law on legal monitoring as a tool for feedback between the legislator and the law enforcement agency. The authors express their conviction that the implementation of the proposed approaches will contribute to the quality of legislation, legal stability, and increased legitimacy of the law in the public consciousness.
