Volunteering as Active Lawful Behavior under Martial Law
Abstract
Abstract. The legal behavior of individuals under martial law differs significantly from legal behavior in peacetime due to the influence of both objective and subjective factors. This article addresses the issue of active lawful behavior of individuals under the legal regime of martial law. It is emphasized that in crisis situations, when the state introduces special legal regimes, changes occur in the behavior of all participants in legal interaction. On the one hand, these changes reflect the conscious compliance with a set of rules established by the state to ensure public safety, national security, and defense. On the other hand, they manifest as socially significant forms of individual activity that respond to current social needs and are likewise connected with issues of social and national security and defense. Active lawful behavior is understood as conduct based on the conscious observance of existing legal norms through active participation in civic life, while the essence of lawful behavior is determined by the nature of social relations. It is noted that the main forms of active lawful behavior of citizens under martial law include the coordination of humanitarian aid, volunteer activity, the organization of evacuation routes, and fundraising. The article demonstrates that volunteer activity constitutes desirable and socially beneficial behavior. Volunteering is considered an activity aimed at achieving socially significant goals and characterized by the following features: voluntariness, non-remuneration, institutionalization, normativity, and legal regulation as sakpened in international and national legal and regulatory acts. The purpose of volunteer activity consists of three components: it is aimed at protecting human rights and freedoms; it involves providing material or psychological assistance; and it serves as a form of personal self-realization.
